This website (“our website”) is owned and operated by Clyde View Holiday Park (Plumbrite Plumbing Pty Ltd T/as), together with its associated entities and complementary businesses (collectively “Clyde View Holiday Park”, “we” or “us”). Each reference in these terms of use to “our website” includes all materials that we make available to you on our website.

By using our website you agree to be subject to and to comply with these terms of use. Please check this page each time you use our website, as we may update these terms from time to time to respond to legal requirements.

These terms of use include terms that limit our liability to you and permit us to disclose your personal information to third parties (in accordance with our Privacy Policy).

Your obligations

You must comply with any instructions we give you about how to use our website and must not do anything that interferes with or adversely affects the normal operation of the website (including the ability of other users to access or use the website).

We cannot guarantee any file, data or program available for download from this website (or any linked website) is free of viruses and accept no responsibility for any loss or damage that may arise from your use of them. You are responsible for ensuring the security of the systems and devices that you use to access our website, including through use of appropriate virus-checking and other security software.

These links are provided for your information only and Clyde View Holiday Park does not sponsor, guarantee, approve of any material or representations on or have control over those websites or the services made available through them.

We do not warrant that material on linked sites is free of any computer virus, defects or infringements and accept no responsibility for them or for any loss or damage that may arise from your use of them.

Liability

While we will use reasonable care and skill in operating our website, we cannot promise that it will always be available or completely free of faults or errors.

To the maximum extent permitted by law, except as expressly set out in these terms of use, we exclude:

  • All conditions, representations and warranties, whether express or implied, in relation to our website and its content (including any warranties as to accuracy or completeness); and
  • Any and all liability (whether in contract, tort (including negligence), or otherwise) for any indirect or consequential loss, damage or expense incurred by you or any other user in connection with our website.

To the extent that we are unable by law to exclude any liability, we limit our liability to the resupply of the relevant information or services.

Prices listed on this website and terms and conditions of any kind relating to products displayed on this site may not be current or complete and therefore under no circumstances constitute an offer or undertaking by Clyde View Holiday Park. We make no representation that the products listed in this site are currently available online or at 107 Beach Road Batehaven NSW 2536 (our location). We reserve the right to change any information on our website at any time including, but not limited to, prices.

You release us to the fullest extent permitted by law from any and all claims arising out of or related to any use of material or information made available through this website.

Nothing in these terms of use restricts, excludes, modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law, including the Competition and Consumer Act 2010 (Cth).

Privacy

We will manage any personal information that we collect through our website in accordance with our Privacy Policy.

We may use cookies to gather data in relation to this website and you consent to us doing so (although you may be able to disable cookies on your web browser).

Governing Law

These conditions are governed by laws of the State of New South Wales, Australia and will be subject to the non-exclusive jurisdiction of the courts of that place.

 

The Small Print

Accommodation General Terms and Conditions of Payment and Booking

General:

CVHP is Clyde View Holiday Park.

Payments and Bookings:

A valid Credit Card must be provided for a Pre-Authorisation bond and required prior to or upon arrival as security for damage caused, extra costs incurred and other charges as outline on the confirmation and or included in these Terms and Conditions and Park Rule Terms and Conditions of entry. This is increased to $200 for all Christmas Holiday bookings. The Pre-Authorisation or Bond is refunded only after an inspection of the villa is completed to management satisfaction.

No site or villa is guaranteed. Every effort is made to allocate your preferred site, but management reserves the right to change a site where the need arises without notice.

Accommodation is based on a nightly and a per head count tariff for all people over the age of two years. The rack rate base tariff is for two people sharing. Extra people not paid for at booking will be chnagred for and payable.

Strictly no overnight visitors unless approved by the office and paid for.

Any damage and breakages must be paid for.

Christmas and Easter Holiday bookings require 50% of the total tariff upon booking.  The balance is to be paid by 1 October (Christmas) and 1 March (Easter).

Discounts:

MyStays, Discounted and Online bookings require 100% payment upon booking.

The Mystays discount program is not guaranteed and is subject to change and is subject to separate Terms and Conditions available upon written request from the Management of Clyde View Holiday Park,

Cancellations, Refunds and Changes:

All reservations and deposits on bookings for Christmas, Easter, MyStays, Discounted and Online bookings are non-refundable and non-transferable, so please book wisely.

For all other bookings, cancellations more than 21 days prior to arrival, a minimum cancellation fee of $60 will be charged. For Cancellations less than 21 days prior to arrival, the higher amount of 50% of the total tariff OR 100% of the deposit will be forfeited.

No refunds for early departures or inclement weather applies to all bookings. Time contracted shall be paid for.

For all bookings if a guest fails to arrive on the nominated day of arrival and fails to notify the office the booking will be cancelled, and no refunds will apply.

Pandemic, Related or Unrelated Illness

For all bookings strictly no refunds will apply for cancellations made due to COVID-19 or pandemic related government mandated travel restrictions or border closures and no refunds will be given for related illness contracted directly or by a related person affecting the booking.

Credit notes may be issued only for COVID-19 or pandemic related government mandated travel restrictions or border closures at the Park Owners discretion. Terms and Conditions (T&C) will apply and can change without notice. If such a credit is agreed to it will only by valid if written confirmation is sent by the General Manager of Clyde View Holiday Park at the time of issuance.

Arrival and Departure:

Check-in time is 2pm on the day of arrival and check-out is 10am on day of departure.

No late arrivals will be accepted after office hours unless prior arrangements are made with the office.

Undeclared:

Guests not declared on original booking, MUST be declared and paid for at the time of check-in. Undeclared guests will be charged at the extra adult/child rate and will be applied to your account and charged to your credit card.

Noise:

Please respect other guests and abide by the park rules. Excessive noise after 10pm will not be tolerated. You may be asked to leave the park immediately. NO REFUNDS WILL BE GIVEN.

CCTV:

Closed circuit television footage (CCTV). Clyde View Holiday Park may collect closed circuit television footage (CCTV footage) when you enter, access or use facilities at Clyde View Holiday Park

Clyde View Holiday Park may disclose CCTV footage (including where it contains personal information that is not de-identified) to the following parties for the following purposes:

  • our related companies for internal reporting and operational reasons;
  • to third party security providers for the purpose of security and surveillance of Clyde View Holiday Park sites;
  • our insurer for the purpose of investigating incidents and/or defending claims; and
  • to law enforcement agencies for the purpose of investigating and/or prosecuting criminal activity, locating missing persons, or as otherwise required or permitted by law.

We may also provide de-identified CCTV footage to research partners for the purpose of research and analysis projects to improve Clyde View Holiday Park security operations and guest and member experience.

It is your responsibility to inform any guests travelling with you or visitors that you may invite to our sites or facilities of our collection and disclosure of CCTV footage.

Tariff Changes

Tariffs are subject to change without notice. Once you have paid your deposit, the tariff is set and will only be changed if an error in calculation or omission of fact has occurred.

Pets Prohibited

No pets are allowed in the park at any time, including visitor’s pets. People found with a pet may be asked to leave immediately and consequently no refunds will be given for unused portion of the stay.

Park Rules

General

Park Management and Security staff oversee these rules which form part of the Conditions of Entry and can direct any person within the Park boundary to leave if they or their visitor, refuses to comply with these Park Rules or other Conditions of Entry, causes nuisance or interferes with the quiet enjoyment of other CVHP guests. Please familiarize yourself with the Park Rules and direct any inquiries to Park Management or after-hours Security Staff.

Reception

Open daily from 9a.m. to 5p.m. Sun to Thurs and Fri 9a.m. to 7p.m in peak and high season. Times can vary without notice. Off season, the office will close earlier.

Check in and Check Out

Check-in is after 2:00 p.m. Check-Out is 10:00 a.m. If a late check out is required, please check availability with the office. Fees apply.

Keys

Lost or non-returned keys are charged at $100 each.

Security

Do NOT leave any items outside unattended and lock your possessions up and your vehicle. Although CCTV is used throughout the park, CVHP will not take any responsibility for lost, damaged or stolen items.

Amenities

Children 10 years and under must always be supervised by an adult. Children are not permitted to play in or around the amenities block at any time. Cleaning times vary. During busy times additional cleaning may occur. No wet suits are to be worn or washed in the showers. Please clean showers after use, using items provided for next guest and for your own safety.

BBQ’s

BBQ’s are available in the amenities block. NO fires permitted anywhere in the Park. BBQ’s on Waterfront Villa Decks are only for the enjoyment of paying guests in those villas. No child under 15 years of age are permitted to light or control BBQ’s for the safety of all.

Bikes, Scooters and Skateboards

It is a condition of riding a bike, scooter, skateboard or using other such machines, that helmets be always worn within the Park no matter the age of the person. No riding is permitted around the amenities block or boomgate area. All bikes, scooters, skateboard or other such machines or other property of value must be locked away securely. CVHP take no responsibility and accepts no liability for any, loss, injury or damages caused whilst in the Park.

Cleaning

Villas must be left in acceptable order, washing up done, rubbish removed and not damaged before return of a security deposit. Charges will apply otherwise. Any damage or maintenance issue found on arrival must be reported to the office shortly after arrival to avoid charges.

Laundry

Laundry facilities are in the amenities block for a small charge. Clothes lines are provided outside the laundry.

Parking

One vehicle only is allowed per site. All other vehicles must park at own risk in the visitor’s car park which is on a first in basis. Do not park outside of your allocated parking space at anytime.

NO Pets Policy

No pets allowed in the Park at any time. This includes but is not limited to dogs, cats, birds, snakes, etc.

Pool

Pool hours are when the office is open. Times vary however generally it is open 7 days a week. Check with the office daily for times.

Everyone must observe and obey all signs. All children 10 years and under must be actively supervised by an adult at all times. Pool is only available to residents and paying guests.

Quiet Time

Guest are required to respect our 10 p.m. Noise curfew so everyone has an enjoyable time. The curfew is 12.30 a.m. on New Year’s Eve. Excessive noise will not be tolerated not unruly behaviour. You may be asked to leave the Park immediately. No refunds will be given.

Refund Policy

No refunds are provided after check-in whatsoever. Refer to your booking confirmation or registration form for full details.

Rubbish

A recycling and rubbish station is located near the entrance to the Park. No bait, prawns, or fish to be placed in the bins. All disposable nappies must be wrapped before placing in bins. Small cardboard boxes must be folded. Place rubbish and recycling items in the correct bins. Only kitchen waste is allowed. No dumping. Fees will apply.

Security Deposit

A pre-authorisation deposit is processed against the credit card on file or on arrival for each booking. In making your booking, you unreservedly agree to the security deposit being processed for damages, extra cleaning charges, extra people, or all other unexpected charges incurred. Cancellation of the deposit will depend on an inspection after departure. Rubbish must be removed, washing up done and villas left clean and tidy considering the length of stay. Unless reported to the office soon after arrival of existing damages, ANY damage found at check-out to villas or facilities will be charged.

Smoking

Strictly NO SMOKING in villas or near facilities. If you feel the inclination to smoke in a villa a $200 fine will be charged for cleaning and deodorising. Please use the balcony and close the door to the villa if you wish to smoke and avoid the fine.

Speed Limit

The limit inside the park is 10km – walking pace. This applies to the entire Park day and night. Always watch out for children, people with a disability and frail people.

Visitors

All visitors must register at the office prior to entering the Park and comply with Conditions of Entry and Park Rules. Guests are reminded they are responsible for their visitors at all times.

Water

Everyone must comply with Eurobodalla Shire Council water conservation and or restrictions that are in force. Car and boat washing are prohibited in the Park. Please recycle water when possible.

WiFi

We have a WiFi Hotspot in the BBQ area and in all Villas. Ask for your code. Only available to Paying Guests, 1 per villa.
